Terms of Service

These Terms govern the provision of website development and related services by the freelancer operating under the brand Bogdn. By using my services, you agree to these Terms.

1. General Provisions

1. The service provider is an independent freelancer operating under the brand Bogdn, website: https://bogdn.com, e-mail: hello@bogdn.com.
2. These Terms apply to all projects performed for clients from Ukraine, the European Union, the United Kingdom, and the United States.
3. Individual terms may be agreed upon in writing or by e-mail.

2. Scope of Services

• Development of websites on the WordPress platform (including Elementor and other plugins).
• Creation of design and responsive layout.
• Performance optimization and basic SEO setup.
• Technical support and consulting.
• Other related services as agreed.

3. Cooperation Process

3.1. Discussion and Estimation

Before starting the project, goals, scope of work, deadlines, and budget are agreed upon.

3.2. Advance Payment

A deposit in the amount agreed upon by the parties (usually 50%) is required to start the work.

3.3. Execution of Work

The project is carried out in stages, with key milestones approved by the client.

3.4. Completion and Payment

After completion and full payment, the project is handed over to the client.

4. Intellectual Property Rights

4.1. Copyright

All copyright and moral rights to the created materials (design, source code, graphics, texts, and other creative works) remain with the developer.

4.2. License to Use

Upon full payment, the client receives an exclusive, perpetual, and worldwide license to use, modify, and distribute the project for any purposes related to their business or personal activities.

4.3. Right of Attribution

• to indicate authorship (for example, placing the signature “Developed by Bogdn” in the website footer, unless otherwise agreed in writing);
• to publish project materials in the portfolio, on the website bogdn.com, and on social media profiles;
• to use screenshots, mockups, and other visual materials from the project for self-promotion.

4.4. Prohibition of Removing Attribution Without Consent

The client may not remove or alter author attribution without the developer’s prior written consent.

5. Confidentiality

1. All information obtained during the execution of the project is considered confidential and will not be disclosed to third parties without the client’s consent.
2. The developer may store backup copies of the project for internal archival purposes.

6. Payment and Refunds

1. Payments are made via bank transfer to the account agreed with the client.
2. Refunds are possible only if the developer has not started work or if both parties agree to terminate the cooperation.
3. Partial refunds may be granted if the project is terminated after it has started, proportionally to the amount of work completed.

7. Liability of the Parties

1. The developer is not liable for any losses incurred by the client caused by:
   • technical failures on the hosting provider’s side;
   • actions or omissions of third parties;
   • improper use of the product by the client.
2. The client agrees to provide information required for the project in a timely manner.

8. Changes to the Terms

The developer reserves the right to amend these Terms. The current version is always available at bogdn.com.
